At Chimcare, we value your privacy and are committed to protecting your personal information across all states in which we operate. This Privacy Policy explains how we collect, use, and safeguard your data.

We collect information that identifies, relates to, or could reasonably be linked to you (“Personal Information”).

  • Contact Data: Name, email address (info@chimcare.com), phone number, and physical service address.
  • Service Data: Details about your chimney, fireplace, and home maintenance needs.
  • Technical Data: IP address, browser type, device identifiers, and operating system.
  • Usage Data: Information on how you use our website and interaction with our digital advertisements.

2. State-Specific Privacy Rights (CCPA/CPRA, VCDPA, etc.)

Depending on your state of residence, you may have specific rights regarding your personal information:

  • Right to Know/Access: You may request to know what personal information we have collected, used, or shared.
  • Right to Delete: You may request the deletion of your personal information, subject to legal exceptions (such as tax or service record retention).
  • Right to Opt-Out of Sale/Sharing: We do not sell data for money. However, we “share” data with ad platforms (Meta/Google) for targeted advertising. You have the right to opt-out of this sharing.
  • Right to Correct: You may request that we correct inaccurate personal information.

3. Digital Tracking and Advertising

To provide the best service and relevant offers, we use modern tracking technologies:

  • Cookies & Pixels: We use the Meta Pixel and Google Tag to track the effectiveness of our ads. This allows us to “retarget” you with relevant chimney service ads on Facebook, Instagram, and Google.
  • Global Privacy Control (GPC): We honor GPC signals from your browser as a valid opt-out request.

4. Data Security & Limitation of Liability

We implement industry-standard security measures, including SSL encryption. However, no method of transmission over the internet is 100% secure.

Limitation of Liability: To the maximum extent permitted by law, Chimcare, its officers, and employees shall not be held liable for any data breach, unauthorized access, or hardware/software failure resulting in the loss of data.


Part 2: Terms of Service

These Terms of Service (“Terms”) govern your use of the Chimcare website and the professional chimney, fireplace, and masonry services provided by Chimcare.

1. Estimates and On-Site Inspection

Any price provided via phone or email is a non-binding estimate. A final, binding quote will be provided only after a physical on-site inspection. Chimcare is not responsible for “hidden” internal damage (e.g., cracked flue liners or rotted masonry) discovered after work begins.

2. Limitation of Liability for Property Damage

To the maximum extent permitted by law, Chimcare shall not be liable for:

  • Pre-existing Conditions: Damage caused by pre-existing structural flaws, aged masonry, or improper previous installations by others.
  • Roof and Siding: Minor wear, scuffing, or pressure marks to roofing materials or siding that occurs during standard ladder use or chimney access.
  • In-Home Dust: While we use professional dust extraction, chimney cleaning is inherently dirty. Chimcare is not liable for microscopic dust particles that may settle in the home despite professional efforts.

Total Liability Cap: In no event shall Chimcare’s total liability for any claim exceed the total amount paid by the customer for the specific service in question.

3. Payments and Collections

  • Payment Due: Payment is due in full upon completion of the service.
  • Late Fees: Past-due balances are subject to a late fee of 1.5% per month (18% APR) or the maximum rate allowed by law in the state where service was performed.
  • Cancellations: We require at least 24 hours’ notice for cancellations. Failure to provide notice may result in a “Trip Fee.”

4. Warranty and Workmanship

Chimcare warrants that its workmanship will be free from defects for a period of one (1) year from the date of service. This warranty does not cover damage caused by “Acts of God” (lightning, heavy storms, earthquakes), normal wear and tear, or customer neglect. Parts warranties are provided by the manufacturers.

5. Governing Law and Venue

These Terms shall be governed by the laws of the state in which the service was performed. Any legal action or arbitration shall take place in the county and state where the customer’s service address is located, unless otherwise agreed upon in writing.

6. Mandatory Arbitration and Class Action Waiver

By using this website or booking a service, you agree that any dispute arising from your interaction with Chimcare shall be settled through binding arbitration. You waive your right to participate in a class-action lawsuit or a jury trial.
